Consultation on a new Management of Health and Safety at Work: Approved Code of Practice

​​​​​Health and Safety at Work (Jersey) Law 1989 provides a legal framework for the management of health & safety at work in order to minimise the risk of harm to workers and the public. The law applies to every business, workplace and work activity in Jersey.

The Law is based on the principle that those who create a risk should be responsible for managing it. It provides a system for self-regulation where the duties to manage risks and prevent harm are absolute, subject only to the qualification of doing what is reasonably practicable.

The Health and Safety Inspectorate (HSI) has identified that in many instances there is a focus on compliance and being told what to do, rather than on active risk management as the Law requires.

HSI’s role is to promote effective risk management in Jersey. We have drafted a new Management of Health and Safety at Work: Approved Code of Practice (ACoP) to help those with duties under the Health & Safety at Work (Jersey) Law 1989 better understand what the law requires them to do.

The new proposed ACoP provides authoritative guidance on how to use the framework of the law, along with other ACoPs and industry guidance to proactively manage work related health and safety risks in order to minimise the risk of harm to anyone who may be affected. 

The new ACoP incorporates existing HSI guidance as well as that published by the UK HSE and other relevant representative industry bodies.

  • the ACoP is applicable to your business sector or workplace
  • the level of detailed guidance provided is appropriate
  • ​​there are any areas not covered in the draft ACoP which should be included
