Draft Construction Regulations 201- lodged for debate

​The final set of draft Health and Safety (Management in Construction)(Jersey) Regulations 201- (draft Regulations), which are intended to replace the existing ‘Construction (Safety Provisions)(Jersey) Regulations 1970’, have now been lodged with the States Greffe. 

They will be debated by the States Assembly on 2 February 2016.

Providing the States agree to the draft regulations, the regulations will come into force on 1 October 2016.

Development of the draft regulations

The draft regulations have been developed and refined in conjunction with a working party. 

This was set up by the industry representative body, the Jersey Construction Council, and followed extensive public and stakeholder consultation.

A report setting out the results of the consultation was published on 4 November 2015.

Amendments made as a result of the consultation

These include, but are not exhaustive:

  • definition of ‘work at height’: the requirements imposed by regulation 27 will be required when there is a foreseeable risk of persons sustaining personal injury, removing the specified qualifying fall height of two metres or more
  • definition of a ‘major construction project’: means a project where the work will take more than 30 working days or 500 person days, ie there is no reference to a threshold of simultaneous workers at any one time
  • ‘high risk work’: excavation into a hillside or re-profiling of an existing slope has been added to the definition (regulation 4)
  • clarification regarding the timing of appointments, particularly of the 'Principal Contractor' and 'Health and Safety Project Co-ordinator', has been included (regulation 7)
  • a requirement to ensure, so far as is reasonable practicable, that a construction site is secured to prevent access to unauthorised persons, whether the site is attended or not (regulation 25)
  • specific reference to the need to assess and control the risk of hazards to health, as well as safety has been incorporated (regulation 34)

Publication

Once the draft regulations have been agreed by the States Assembly, it is the intention to develop authoritative guidance on the regulations.
