Can you let me know the following information please with regards to pupils excluded from schools.

A

How many pupils have been excluded from Government of Jersey primary schools for the last four years, 2015, 2016, 2017 and 2018?

B

Of those excluded, what were the reasons for those exclusions?

C

Of those excluded, how many were permanent and how many were temporary?

D

How many pupils have been excluded from Government of Jersey secondary schools for the last four years, 2015, 2016, 2017 and 2018?

E

Of those excluded, what were the reasons for those exclusions?

F

Of those excluded, how many were permanent and how many were temporary?

The information requested is partly available in previous Freedom of Information responses dated 30 November 2017;

Therefore Article 23 (Information accessible to applicant by other means) of the Freedom of Information (Jersey) Law 2011 (the Law) has been applied to that part of the request.

This data outlines only exclusions where reasons have been recorded.

The Education Department have determined that revealing the breakdown of reasons when there is less than five (<5) exclusions in a particular category would likely breach the privacy of the individuals and therefore, Article 25 (Personal Information) of the Law has been applied.

There were no permanent exclusions from Primary Schools during the period 2015 to 2018 therefore all were temporary.

This data outlines only exclusions where reasons have been recorded.

It should be noted that the process for recording exclusion data changed on 19 February 2018, therefore data prior to this date has been converted into the statutory reason codes held in the current system.

Articles applied

Article 25 Personal Information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.

Article 23 Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.
