The Jersey Health and Care Partnership Group is an independent group of health and social care organisations and charities established to provide a platform where opportunities to join up health and community care can be explored as we seek to increase the health and wellbeing outcomes for all Islanders.

The Jersey dDeaf Partnership Board was established in March 2006. It is an independent group whose members include various Government agencies, voluntary organisations, charitable organisations.

An FOI in 2022 provided information on membership, titles, and where possible, qualifications for The Jersey Health and Care Partnership Group.

A Freedom of Information response in 2023 provided various reasons information could not be provided for the The Jersey dDeaf Partnership Board.

Both are independent groups, and I am unable to understand why information should be forthcoming from one, and not from the other. Please can this be explained?

The Government response states that the Jersey Health and Care Partnership Group is an independent group and therefore not (by the same reasoning) a Scheduled Public Authority.

I would also like to see where (in the law) the Jersey Health and Care Partnership Group is listed as a Scheduled Public Authority, if it is?

Response

The Freedom of Information (Jersey) Law 2011 provides public access to recorded information held by Scheduled Public Authorities (SPAs).

Neither the Jersey Health and Care Partnership Board, nor the Jersey dDeaf Partnership Board are SPAs. Health and Community Services (HCS), as with all other Government of Jersey Departments, is a SPA. As such, information held by HCS is covered by the Freedom of Information (Jersey) Law 2011.

The Jersey Health and Care Partnership Board is commissioned by the Government of Jersey, and Health and Community Services (HCS) held the information requested in respect of this Board for the 2022 Freedom of Information request referenced, published April 2022:

Health and Community Services groups and forums (FOI)

HCS do not hold the information requested for the Jersey dDeaf Partnership Board, which is not commissioned by the Government of Jersey. In the Freedom of Information response referenced (published February 2023), HCS provided guidance on approaching the Jersey dDeaf Partnership Board directly to obtain the information sought. It was noted in the response that Jersey dDeaf Partnership Board is not a SPA and is, therefore, not obliged to disclose the information under FOI legislation:
