The names and the roles of the St John’s Road Road Safety Board (the ‘Board’) have evolved of the period of its existence.

This Board is an informal political advisory board formed by Deputy Inna Gardiner in 2019, while the Board is acknowledged by the Minister for Infrastructure and the Parish of St Helier, the Board itself has no formal powers. Its function can be précised as acting as communications conduit between the community and the by-roads and highways authorities, to identify local traffic issues of concern and guide the development of potential options for improvement and, where acceptable to the relevant authority, engagement with the community.

In 2022 the chair requested that the membership of the board be expanded to include additional and the current membership is detailed below:

• St Helier Roads Committee Representative 
• Haute Vallee School Representative
• 2 residents of St John’s Road

The initial criteria for option development are shown in the attached St John’s Road Presentation dated December 2019 (5).  These options were further refined in the attached presentation dated October 2022 (6).

Following political discussions with the Minister for Infrastructure and the Constable of St Helier, outputs of original options assessment were considered unviable for delivery, thus a modified version of Option 5 developed further based upon the suggestion of one of the residents on the board. This modified option was presented to the St Helier Roads Committee who considered it to have merits and requested that it be further developed, in order that a community engagement event could be arranged and an experimental layout trialled and assessed. While the Board has been kept informed throughout the discussions between the statutory roads' authorities, they have not been party to the decision making having no statutory status.  

The provisional criteria for success of the experimental layout are set out in the attachment (7).

Article 10 - Obligation of scheduled public authority to confirm or deny holding Information

(1) Subject to paragraph (2), if –

(a) a person makes a request for information to a scheduled public authority; and

(b) the authority does not hold the information, it must inform the applicant accordingly.

(2) If a person makes a request for information to a scheduled public authority and –

(a) the information is absolutely exempt information or qualified exempt information; or

(b) if the authority does not hold the information, the information would be absolutely exempt

information or qualified exempt information if it had held it, the authority may refuse to inform the applicant whether or not it holds the information if it is satisfied that, in all the circumstances of the case, it is in the public interest to do so.

(3) If a scheduled public authority so refuses –

(a) it shall be taken for the purpose of this Law to have refused to supply the information requested on the ground that it is absolutely exempt information; and

(b) it need not inform the applicant of the specific ground upon which it is refusing the request or, if the authority does not hold the information, the specific ground upon which it would have refused the request had it held the information.

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2005; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
