The following documents have been provided as they were used to inform the decision to install a traffic signal-controlled pedestrian crossing at the referenced site.

The Scheduled Public Authority received correspondence from 5 parties that related to the possible requirement for a pedestrian crossing at this location.

The cost of the detailed design, project procurement, project supervision and construction for the reference site was £220,466.99. 

The traffic and pedestrian surveys and the initial technical reports were undertaken as ‘business as usual’ work using Scheduled Public Authority resources and no cost was recharged to the project.

The Scheduled Public Authority does not record the time spent by the transport team on ‘business as usual’, therefore, this information is not held and Article 3 of the Freedom of Information (Jersey) Law applies.

The Scheduled Public Authority does not record the number of times that the crossing button is pressed, therefore this information is not held and Article 3 of the Freedom of Information (Jersey) Law 2011 applies.

The Freedom of Information (Jersey) Law 2011 gives a right to request information that is held in recorded form, unless exempt. 

The second part of question 5 poses a question rather than seeking information held in a recorded form, therefore, this information is not held and Article 3 also applies.

Articles applied

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.​

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.​
