Employing staff (registration cards)

Employing new staff and registration card checks

When you start up a business, you’ll need a business licence. Find information about this on our starting up a business page

Once a business licence is in place, you can employ staff.

Before taking on an employee, you must check that they have a registration cardThe registration card will show the person's residential and employment status. It will be one of the following:

  • 'entitled'
  • 'entitled for work'
  • 'licensed'
  • 'registered'

When the employee shows you their registration card, you should:

  • check the card is in date
  • ask for photo ID
  • if they're 'registered' or 'licensed', ensure you have permission on your business licence to employ someone with this status

If you decide to employ the person, you should:

  • take a photocopy of the card and photo ID
  • return the card to the employee

Who you can employ

You can employ as many 'entitled' or 'entitled for work' staff as you want.

However, you need permission from Business Licensing to employ anyone whose status is 'licensed' or 'registered'. You may already hold permission to do this. If you do not, you can apply.

If your prospective staff member is not a British or Irish national or a European  Union (EU) national with Settled or Pre-settled Immigration status or eligible for this status, then you may also require an Immigration work permit. You must have a ‘registered’ or ‘licensed’ permission before you can apply for this. Permission to employ "licenced or "registered" staff 

'Registered' and 'licensed' permissions are restricted to maximise opportunities for 'entitled' / 'entitled for work’ residents and restrict migration. New permissions can only be granted where the application demonstrates there will be significant social and economic value. Licensed permissions also give access to qualified housing and are designed to assist employers with recruitment to 'essential' (senior) posts and where it is clearly in the best interests of the community to do so. 

When deciding whether to grant a business a license to employ ‘registered’ or ‘licensed’ staff, the team will consider the following matters:

  • protecting and maximising the benefits of Jersey’s resources 
  • promoting a balanced and successful economy 
  • protecting the integrity and reputation of Jersey in commercial and financial matters 
  • any relevant policies of the Government of Jersey 
  • whether such a grant would be in the public interest

You can apply for permission to employ additional 'registered' or 'licensed' staff by completing our online form below. It is not necessary to know the identity of the staff member you wish to employ, but if you do know this, the form will also check if you need an Immigration work permit for this individual.

Apply for registered and or licensed staff

You will need the following information to complete this form :

  • details of your current staffing numbers broken by residential status and contract type
  • details of the roles you are seeking Registered or Licensed permission for including: 
    • salary
    • experience and qualifications required
  • evidence of where you have advertised the roles you are applying for Registered or Licensed permissions (i.e. photo of job advert(s)/email confirmation from the Back to Work Recruitment team that the job was advertised on gov.je/email confirmation from a recruitment firm)
  • results of your recruitment including: 
    • how many people applied for the roles
    • details of why each ‘entitled’ or ‘entitled to for work’ applicant was unsuccessful
  • information about your training, development and succession planning
  • evidence of your financial contribution to the island (including profits, salary costs, tax benefits)
  • evidence of wider benefits to the community that will occur as a result of granting the permission for example job creation and training or important services to islanders

Fees for "registered" and "licensed" permissions

There’s an annual charge for each 'registered' and 'licensed' permission that you hold on 1 November of each year. You don’t need to do anything, if your application is successful you’ll receive a bill payable by 31 December.

The cost for a "registered" permission is £50 and for a "licensed" permission it’s £225.

Staffing limits

Your staffing limits can be found on your business licence. They set out the number of 'registered' and 'licensed' individuals you are permitted to employ, which may be zero. The staffing limits will also specify if there are roles or individuals that you must use the permissions for. If you want to know staffing limits, review your business licence or call on +44 (0) 1534 444444 or email business licensing to gain a copy.

You must not go over your staffing permissions. Exceeding your limit is against the law.

You don't need to tell us when you've taken on a new employee who is covered by the staffing limits on your business licence. This will be picked up through your manpower return.

Cards for ‘licensed’ employees

When taking on a 'licensed' employee, you need to fill out an application for a licensed registration card.

Your employee will need this to be able to get a registration card from us at Customer and Local Services.

Temporary staff from an agency

If you employ temporary staff through a recruitment agency, you don’t need to see their registration card. They will be covered by the agency’s business licence.
