Family, Food and Fitness Programme privacy notice

The Family, Food and Fitness Programme is delivered by Public Health (Government of Jersey) and Jersey Sport.

Public Health, which is a part of the Strategic Policy, Planning and Performance Department, and Jersey Sport, are 'Joint Controllers' under the Data Protection (Jersey) Law 2018 (the "Data Protection Law"). Both determine the purpose and means of the processing of the personal information collected about you for this service.

We process and hold your information to provide public services and meet our statutory obligations. This notice explains in detail how we use and share your information to provide the Family Food and Fitness Programme.

We will review and update this privacy notice to reflect changes in our services and feedback from service users, as well as to comply with changes in the law.

How we collect information about you

Information about you and your family will, in most cases, be collected directly from you, or the parent or guardian. This may be done by:

  • an online form
  • paper forms
  • telephone or text
  • email
  • a member of our staff from the Government of Jersey or Jersey Sport
  • a healthcare professional who can refer you to the Family Food and Fitness Programme through our online application form. This will involve the healthcare professional going through the form with you 

Types of information we collect

The types of personal data collected will vary depending on what information you volunteer and the information we require in each circumstance. The most common categories of information we collect about you are: 

  • your name, address, contact number and email address
  • any names of organisations you or your child are associated with, such as the name of the school your child attends
  • any sensitive health information such as any medical conditions, allergies, weight, and height
  • your GP's details so that we can contact them in case of emergencies or if any concerns are identified
  • details about physical activity. Participants will be provided Smart Activity Trackers to measure their daily step count, active minutes and water intake through the Fitbit app or their own application of choice. Participants give information collected in their trackers directly to staff by email or in person.
  • your preferences, questions addressing knowledge, attitudes or intentions regarding food related behaviours and physical activity
  • any voluntary information you may provide to us when you engage with us

How we will use the information about you

We collect and hold information about you to carry out the public functions of the Public Health Department. Our legal basis for processing personal data in most cases is that it's necessary for the exercise of a public function of the States or any public authority (Schedule 2 para 4(b) of the Data Protection Law).

Who we may share your personal information with

Other data controllers

Your data will be shared with Jersey Sport for the purpose of delivering Family Food and Fitness.

We may disclose information to other public authorities where necessary, either to comply with a legal obligation, or where required under other legislation. Examples of this include, but are not limited to:

  • the prevention or detection of crime
  • for national security purposes
  • for the purposes of meeting statutory obligations
  • to prevent risk of harm to an individual

In some instances, this data sharing may require us to transfer your personal data outside Jersey and the EEA. This is done with the necessary safeguards in place and where it is lawful because it is necessary and proportionate for the proper discharge of our statutory functions.

Service providers

Your personal data may be processed on our behalf by third parties who provide services to us. We have contracts in place with these service providers to ensure they process your data only on our instructions and with appropriate security in place. The categories of third parties who may receive your personal data to provide us with a service are:

  • email and data storage providers such as Microsoft
  • IT support or security service providers such as Prosperity 24/7

At no time will your information be passed to organisations for marketing purposes, sales purposes, or for any commercial use without your prior express consent.

How long do we store the information about you?

We will keep your information accurate and up to date and not keep it for longer than is necessary to facilitate your family's completion of the Family Food and Fitness programme. This will be after one year after completion of the programme once families have been followed up. More information can be found on Public Health's retention schedule.

Where do we store the information about you?

Government of Jersey systems store data in Jersey, the UK, and the European Union. The UK has been granted adequacy status by the European Commission and personal data stored there will be protected to the same standards as personal data held in Jersey and the EU.

You are not obliged by any law or contract to provide us with your personal data.

If you choose not to provide certain information when requested, we will not be able to monitor your progress within the Family Food and Fitness programme and support you in achieving the best possible outcomes.
