Published in the Bailiwick Express on the 25 July there was an article that claimed 100% of public sector applications for licensed employees were approved last year. I do not see the response to this request published on gov.je

I would like to request the original applications made by States departments to the population office for these positions for 2017 and 2018. Indicating which department made the request and the general nature of the role that was to be filled.

Specifically I am interested in the records of the actual submissions made by the States departments to the population office for these licenses, including any records that show to what extent the department had gone to to determine that there was no local talent available for these positions.

I presume that these applications are made before hiring outside of the island so these should not contain any personally identifiable information.

Each quarter and annually the Social Security department publish data on Registered and Licensed permissions that have been requested, granted, refused and removed by industry sector.

This data is available from the site below from 2015 onwards.

Please note the following points when reviewing the applications:

  • licensed permissions are granted to the business as a condition of the Business Licence for a specific role not direct to an individual

  • a single application can be made for one or more Licensed permissions

  • applications have been included for ‘arms length’ organisations that are not States of Jersey departments but for whom the Licensed applications were made by the States of Jersey

  • personal data which would identify individuals has been redacted or removed from the applications under Article 25 of the Freedom of Information (Jersey) Law 2011. The personal data redacted does not add to the application but does reveal personal information about individuals. For example career aspirations and history, numbers of individuals less than five, and information that specifically relates to that individual. On balance we concluded that the public interest to release the information was outweighed by the privacy rights of the individuals concerned

  • private sector applications are made via the published application forms inclusive of required information whilst the public sector applications are usually by letter inclusive of required information

  • licensed permissions in both the public and private sector can also be varied (removed and granted) by the Minister under Article 29 of the Control of Housing and Work (Jersey) Law 2012

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
