I would like to know if you can request police body camera footage under the Freedom of Information (Jersey) Law 2011 and if so what steps I would need to take to receive it.

Response

Body worn video taken by police officers will contain the personal data of one or more individuals and would therefore be exempt from disclosure under Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011.

If an individual would like to see evidential video before their court case or Parish hall enquiry, procedures are in place to facilitate this. Video footage that is not used for court or evidential purposes is deleted after 30 days.

Any other requests are processed on a case by case basis using the principles of the Data Protection (Jersey) Law 2018.

Article 25 Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
